I have been invited to participate in certain hunting activities by Heartland Energy in Madison. I understand that accidents can occur during hunting activities and while traveling to hunting areas. I further understand the potential risks associated with hunting activities and with the transportation to and from the hunting area and in consideration of my participation in the hunting activities, I hereby agree to assume all risks connected therewith. For and in consideration of the transportation and hunting opportunity being provided to me, I hereby agree to release and discharge in advance Heartland Energy, its officers, directors, shareholders, insurers, employees, volunteers, contractors, customers, and agents (collectively “Released Parties”) from any and all liability associated with, and hereby assume full responsibility for, personal injury, death, or property damage suffered by me and connected with or arising out of my participation in any hunting activities sponsored by Released Parties and the transportation from and back to Flandreau and Madison.

I acknowledge that none of the Released Parties have made any representations or warranties as to the nature or condition of the property upon which I will be hunting. I further understand that none of the Released Parties are involved in, or responsible for the inspection of, the transportation equipment or vehicles used in transporting me or the inspection of any of said hunting facilities or properties and are not involved in the supervision of, or responsible for, the conduct of other guests. I acknowledge that hunting involves walking and movement in areas where there are holes, fences, ditches, rocks, tree branches, sight obstructions, and other hazards, which can, directly or indirectly, result in injury to people. I also understand that hunting necessarily involves the use of firearms which are inherently dangerous. Furthermore, I understand that hunting and other activities on rural property have unknown hazards and risks and can result in injury or property damage to the person participating in such activities. The many possibilities and sources of injury or damage associated with hunting and travel for hunting are acknowledged by me, and by signing below, I represent that I understand the risks and willingly assume all such risks.
